Terms of Use

Welcome to Go Viral, the short-form video analysis application operated by FLIVIO OU (“FLIVIO,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Go Viral mobile application and related services (the “App”). By downloading, installing, or using the App you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement and have legal capacity to enter into a binding agreement.

2. License & Intellectual Property

1. Limited License. FLIVIO grants you a personal, non-exclusive, non-transferable, revocable license to download and use the App to analyze your short-form videos, receive recommendations, and access related insights, subject to these Terms.
2. Ownership. All software, prompts, analytics, and other materials in the App are owned by FLIVIO or its licensors and are protected by copyright, trademark, and other laws. Except for the limited license above, no other rights are granted.
3. Restrictions. You may not (a) copy, modify, distribute, sell, or lease any part of the App; (b) reverse-engineer or attempt to extract source code or system prompts; (c) circumvent security or usage limits; (d) use the App to develop competing services; or (e) use the App for any unlawful purpose.

3. In-App Purchases

1. Subscriptions & One-Time Purchases. The App offers (i) auto-renewing subscription plans without free trials and (ii) one-time purchase items. Prices are displayed in the App and may vary by region.
2. Billing & Auto-Renewal. Subscription fees are charged to your Apple ID or Google Account upon confirmation. Subscriptions renew automatically for the same period unless canceled at least 24 hours before the end of the current term.
3. Managing or Canceling. You can manage or cancel subscriptions in your device settings (App Store / Google Play). Uninstalling the App does not cancel a subscription.
4. Refunds. Refunds are handled solely through Apple (App Store) or Google (Play Store) according to their policies. FLIVIO does not provide direct refunds.
5. Price Changes. We may change prices at any time. If required by your app store, you will receive notice and may accept the new price or cancel.

4. User Content

The App allows you to upload short-form video clips and related metadata solely for analysis purposes (“Video Submissions”). By submitting content you represent that:

• You own the content or have all necessary rights, licenses, and permissions to submit it.
• Your submission does not infringe or violate any third-party rights, including copyrights, privacy, or publicity rights.

You grant FLIVIO a limited, worldwide, royalty-free license to process Video Submissions transiently in order to operate the App, generate recommendations, and maintain service integrity. We do not store your videos after analysis; outputs are saved only on your device unless you export or share them yourself.

You are solely responsible for backing up your Video Submissions and results. We do not guarantee that analysis history will remain available if you delete the App, clear local storage, or change devices.

5. Acceptable Use

You agree not to:

• Violate any applicable law or regulation;
• Upload content you do not own or have the right to use, or that contains personal data of others without consent;
• Attempt to gain unauthorized access to the App, servers, or networks;
• Use the App to infringe intellectual-property rights or privacy rights of others;
• Interfere with or disrupt the integrity or performance of the App; or
• Submit content that is malicious, spam, or that promotes hate, violence, or illegal activity.

6. Disclaimers

1. No Warranty. The App is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or meet your expectations.
2. AI Insights. Go Viral delivers AI-generated assessments, predicted metrics, and suggested improvements. These outputs are probabilistic, may contain inaccuracies, and are not a promise of future performance, virality, revenue, or audience growth. You remain solely responsible for how you use the insights.

7. Limitation of Liability

To the fullest extent permitted by law, FLIVIO and its affiliates, directors, employees, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the App. Our total liability under these Terms shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim or (b) EUR 50.

8. Indemnity

You agree to indemnify and hold harmless FLIVIO and its affiliates from any claims, damages, or expenses (including legal fees) arising out of your breach of these Terms or misuse of the App.

9. Termination

We may suspend or terminate your access to the App at any time, without notice, if we believe you have violated these Terms. Upon termination, the license granted to you will cease immediately.

10. Changes to the Terms

We may update these Terms from time to time. Material changes will be announced in the App or on this page at least 7 days before they take effect. Continued use of the App after the effective date constitutes acceptance of the revised Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of Estonia, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App shall be submitted to the exclusive jurisdiction of the competent courts in Tallinn, Estonia.
